What qualifies as a lemon under California law?+
California's Song-Beverly Consumer Warranty Act (the Lemon Law) covers new and used vehicles purchased or leased with a manufacturer warranty when: (1) the vehicle has substantial defects covered by the warranty, (2) you've given the manufacturer a reasonable opportunity to repair, and (3) the defects substantially impair use, value, or safety. Reasonable opportunity is typically 2 attempts at the same defect, 4 attempts at any warranty defect, or 30+ days out of service.
What can I get from a Lemon Law claim?+
Three remedies: (1) replacement vehicle of equivalent value; (2) repurchase (refund of purchase price minus a usage offset based on miles driven before the first repair attempt); (3) monetary damages with the vehicle retained. Manufacturer pays attorney fees in successful cases (Civil Code § 1794(d)) — meaning we don't take a fee from your settlement. Successful Lemon Law cases also recover registration, tax, finance charges, and incidental costs.
Can I file Lemon Law for a used car?+
Yes — for used vehicles still under the original manufacturer warranty, certified pre-owned (CPO) warranties, and some service contracts. The vehicle must have been purchased in California, the defect must be covered by the existing warranty, and the manufacturer must have had reasonable opportunity to repair. We frequently win Lemon Law cases on used CPO vehicles where dealers tried to deny coverage.
How long do I have to file a Lemon Law claim?+
Generally 4 years from when you discover (or should have discovered) the defect under California Code of Civil Procedure § 337. Practically, we file as soon as the manufacturer has had reasonable repair attempts. Don't wait — manufacturers gain leverage when the warranty period expires and the defect record gets stale.
